This Privacy Policy covers the information we collect about you when you use our products or services, or otherwise interact with us (for example, by contacting us directly or attending any events held by us), unless a different policy is displayed. Colliander Studio, "We", "Us" and "Our" refers to Colliander Studio ApS, Company Registration No. DK37624152, Annasvej 3, DK-2840 Holte, Denmark, and any of our corporate affiliates. We offer a range of products: a website (www.guitarking.com), a mobile app for iOS (GuitarKing), "the App", and services associated therewith. We refer to all these products as "Services" in this policy.
This policy also explains your choices about how we use information about you. Your choices include how you can object to certain uses of information about you and how you can access and update certain information about you. If you do not agree with this policy, do not access or use our Services or interact with any other aspect of our business.
What information do we collect about you?
The app works entirely offline except for crash reporting to Bugsnag and optional user-initiated support emails.
We collect information about you when you provide it to us directly, when you use our Services, and when other sources provide it to us, as further described below. We do not operate any user accounts, logins or cloud profiles, and we do not collect or store personal data through the app.
Information you provide to us
We do not offer any form of signup or creation of a profile, nor do we give you an opportunity to input any personal information into our mobile app. Any personal information you provide us, will have to be provided through email or physically.
Microphone Use: Our app uses the device microphone solely for real-time audio processing to provide musical feedback. All microphone data is processed locally on your device. No audio is recorded, transmitted, or stored by us or any third party. Audio never leaves the device and is processed in real-time only for pitch recognition.
In-app configuration: Your in-app configuration (including but not limited to: instrument type, tuning, number of strings, number of frets on your instrument, your difficulty level, your practice speed (bpm), the notes you practice, the scales you practice) is stored locally on your device and is not collected by us. We do not collect any personal information when you use our Services as intended.
Content you provide through our Services:
If you are in touch with our support agents about resolving issues in the Service or any other issues, we keep the information about your interactions with us to help us provide a better service.
Any purchases you make are handled by Apple through your Apple ID account. We do not receive any payment information from you. For more information about how Apple handles your payment information, please see Apple's Privacy Policy at https://www.apple.com/legal/privacy/en-ww/.
Sometimes, if we run special campaigns or sweepstakes, like giving out instruments, we may need some additional information from you, such as an address where we can ship the instrument. In these cases, we provide more details to you about why we are collecting the data and how we use it when you sign up for or enter or sign up for the campaigns or sweepstakes.
Information we collect automatically when you use the Services
We collect information when you use our Services.
Your use of the services: We collect information about your use of the Services only to track errors within the Services, and only to the extent necessary to provide you the Services and to improve and develop the Services. We collect this data anonymously through our service partner Bugsnag. Crash reports may include anonymized device data (e.g., OS version, device model). Crash reports do not include names, email-addresses, IP addresses or advertising identifiers. We maintain a Data Processing Agreement with Bugsnag to ensure GDPR-compliant handling of any anonymized crash data. Bugsnag is operated by SmartBear Software, Inc. and acts as our data processor for crash reporting. For transparency, you can review the security documentation on https://docs.bugsnag.com/security. We remain the data controller and rely on Standard Contractual Clauses or other lawful transfer mechanisms for any international transfers.
Cookies and Other Tracking Technologies: We do not use cookies or tracking technologies for analytics or marketing. Our website may use strictly necessary cookies only. For more information, please see our Cookies and Tracking Notice.
Information we receive from other sources
When you interact with our Services, and content created by us and our advertising partners, for example through social media, we receive information from the platform in question about your interactions with our content. We may use this information for analytics, for example for evaluating marketing campaign performance. We do not store any personal information (such as your name) in this process. We use your information to the extent allowed and provided to us by the platform in question. Please refer to the privacy policy of the Social Media Platform in question on how to control your data on their platform.
How do we use the information we collect?
How we use the information we collect depends in part on which Services you use, how you use them, and any preferences you have communicated to us. Below are specific purposes for which we use the information we collect about you.
To provide the support within and in relation to the Services: We use information about you to provide you with customer support in case of errors or other difficulties you experience within the Services. We do this in order to be able to provide you with support for your specific use case. Examples may be:
- when you contact us by email for support, we store and use your email address in order to reply to your request.
- when you contact us by email for support, we store and use your name if provided in order to reply back to you in a formal and polite manner that addresses you directly.
- when you contact us by email for support, we may attempt to identify any errors you've experienced within the services by associating any device information you give us with an error stored by our error tracking partner. We make this connection between your device and an event within our Services in order to be able to provide you with assistance, and to improve our Services for all users of the Services.
For marketing purposes:
We do not conduct direct marketing and do not share user contact information with advertisers.
Automated decision-making or profiling
We do not perform automated decision-making or profiling.
Customer support: We use your information to resolve technical issues you encounter, to respond to your requests for assistance, to analyse crash information, and to repair and improve the Services.
To protect our legitimate business interests and legal rights: Where required by law, or where we believe it is necessary to protect our legal rights, interests and the interests of others, we use information about you in connection with legal claims, compliance, regulatory, and audit functions.
Processing in relation to mergers and acquisitions: If We are involved in a reorganization, merger, acquisition or sale of our assets, personal data may be transferred as part of that deal. Our legitimate interests pursued by the processing is to be able to execute the reorganization, merger, acquisition or sale of our assets in question.
With your consent: We use information about you where you have given us consent to do so for a specific purpose not listed above. For example, we may publish testimonials or feature any contest winners content to promote the Services, with your permission.
Legal bases for processing (for EEA users):
If you are an individual in the European Economic Area (EEA), we collect and process information about you only where we have legal bases for doing so under applicable EU laws. The legal bases depend on the Services you use and how you use them. This means we collect and use your information only where:
- We need it to provide you the Services, including to operate the Services, provide customer support and personalized features and to protect the safety and security of the Services.
- It satisfies a legitimate interest (which is not overridden by your data protection interests), such as for research and development, to market and promote the Services and to protect our legal rights and interests.
- You give us consent to do so for a specific purpose.
- We need to process your data to comply with a legal obligation.
If you have consented to our use of information about you for a specific purpose, you have the right to change your mind at any time, but this will not affect any processing that has already taken place. Where we are using your information because we have a legitimate reason to do so, you have the right to object to that use, although, in some cases, this may mean no longer using the Services.
We do not process special categories of personal data.
How our purposes map to legal bases:
- Support emails: performance of a contract (or steps at your request) and/or our legitimate interests (providing support).
- Crash reports (Bugsnag): our legitimate interests (service reliability, safety, and improvement).
- Sweepstakes/shipping: performance of a contract; and consent where required.
- Legal compliance: legal obligation.
How is the information shared?
We want our Services to work well for you. This means sharing information through the Services and with certain third parties. We share information we collect about you in the ways discussed below, including in connection with possible business transfers, but we are not in the business of selling personal information about you to advertisers or other third parties.
We do not sell or share personal information as those terms are defined under California law (CPRA). We also do not use personal information for cross-context behavioral advertising or targeted advertising.
Sharing with other Service users
In case you enter and win a form of contest or sweepstakes we may share certain information about you with other Service users, with your permission, to inform other Service users of the results of the contest or sweepstakes in question.
Sharing with third parties
We share information with third parties that help us operate, provide, improve, integrate, customize, support and market our Services.
Service Providers: We work with third-party service providers to provide hosting, maintenance, backup, storage, virtual infrastructure, payment processing, analysis and other services for us, which may require them to access or use information about you. If a service provider needs to access information about you to perform services on our behalf, they do so under close instruction from us, including policies and procedures designed to protect your information. We maintain data processing agreements with all processors to ensure GDPR-compliant handling of any personal data.
GuitarKing Partners: We work with third parties who provide consulting, sales, and technical services to deliver and implement solutions around the Services. We may share your information with these third parties in connection with their services, such as to assist with billing and collections, provide localized support, and to provide customizations and improvements to the Service. We may also share information with these third parties where you have agreed to that sharing.
Links to third party sites: The Services may include links that direct you to other websites or services whose privacy practices may differ from ours. If you submit information to any of those third party sites, your information is governed by their privacy policies, not this one. We encourage you to carefully read the privacy policy of any website or third party service you visit.
Social Media Widgets: Some of our Services contain widgets and social media features. These widgets and features collect your IP address, which page you are visiting on the Services, and may set a cookie to enable the feature to function properly. Widgets and social media features are either hosted by a third party or hosted directly on our Services. Your interactions with these features are governed by the privacy policy of the company providing it.
With your consent: We share information about you with third parties when you give us consent to do so. For example, our Services may include sponsored contests or sweepstakes. With your consent, we may provide your personal information to these partners. Please make sure to read any unique contest or sweepstake terms and policies before you sign up for sponsored content as these terms and policies may differ from this policy.
Compliance with Enforcement Requests and Applicable Laws, Enforcement of Our Rights: In exceptional circumstances, we may share information about you with a third party if we believe that sharing is reasonably necessary to (a) comply with any applicable law, regulation, legal process or governmental request, including to meet national security requirements, (b) enforce our agreements, policies and terms of service, (c) protect the security or integrity of our products and services, (d) protect GuitarKing, our customers or the public from harm or illegal activities, or (e) respond to an emergency which we believe in good faith requires us to disclose information to assist in preventing the death or serious bodily injury of any person.
Sharing with affiliated companies: We share information we collect with affiliated companies and, in some cases, with prospective affiliates. Affiliated companies are companies owned or operated by us. The protections of this privacy policy apply to the information we share in these circumstances.
Business Transfers: We may share or transfer information we collect under this privacy policy in connection with any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company. You will be notified via email and/or a prominent notice on the Services if a transaction takes place, as well as any choices you may have regarding your information.
How do we secure and store the information we collect?
Information storage and security
We use data hosting service providers in the United States and Europe to host the information we collect, and we use technical measures to secure your data. The security of all communications with our Services and support team is determined by the internet connection through which you communicate with us. All internal transfer of your data within our team and to our partners are handled on secure and known networks.
Our security is reviewed regularly. We have taken necessary technical and organizational security measures to protect personal data against accidental or unlawful destruction, loss or alteration and against the unauthorized disclosure, abuse or other processing in violation of applicable law. We store and process your personal data on IT systems with controlled and limited access. The systems are located on servers in secured premises.
We use industry standards in firewalls and authentication protection to safeguard personal data.
While we implement safeguards designed to protect your information, no security system is impenetrable and due to the inherent nature of the Internet, we cannot guarantee that data, during transmission through the Internet or while stored on our systems or otherwise in our care, is absolutely safe from intrusion by others.
If you send personal data by email to us, you should be aware that the data is not secure if your email is not encrypted.
In the event of a personal data breach affecting information we control (such as support emails), we will notify the relevant supervisory authority within 72 hours and, where legally required, affected users without undue delay.
How long we keep information
How long we keep information we collect about you depends on the type of information, as described in further detail below. After such time, we will either delete or anonymize your information or, if this is not possible (for example, because the information has been stored in encrypted backup archives), then we will securely store your information and isolate it from any further use until deletion is possible.
Information you provide to the Services: If you contact us for support, we will retain your information for as long as necessary to provide you with support and to improve our Services. If you enter a contest or sweepstakes, we will retain your information for as long as necessary to administer the contest or sweepstakes and for a reasonable period thereafter to comply with legal obligations. Support emails are retained only as long as necessary to respond to your request and ensure service quality, then deleted or anonymized. Crash logs from Bugsnag contain no personal identifiers.
How to access and manage your information?
You have certain choices available to you when it comes to your information. Below is a summary of those choices, how to exercise them and any limitations.
Your choices:
You have a right to request a copy of your information, to object to our use of your information (including for marketing purposes), to request the deletion or restriction of your information, or to request your information in a structured, electronic format. Below, we describe the tools and processes for making these requests. To exercise these choices, you may contact us as provided in the Contact Us section below to request assistance.
We respond to EEA/UK data rights requests within one month of receipt, extendable as permitted by law for complex or numerous requests.
Your request and choices may be limited in certain cases: for example, if fulfilling your request would reveal information about another person, or if you ask to delete information which we are permitted by law or have compelling legitimate interests to keep.
Where you have asked us to share data with third parties, for example, by using Social Media Providers, you will need to contact those third-party service providers directly to have your information deleted or otherwise restricted. If you have unresolved concerns, you may have the right to complain to a data protection authority in the country where you live or where you feel your rights were infringed.
Access and update your information: You can request us to provide you with a copy of any personal information you have provided us through direct contact, such as email, with our support team and other Services, by sending us a request by email to support@guitarking.com, we will respond to your request within a reasonable timeframe.
Delete your information: You can request us to delete any personal information you have provided us directly. In order to do so, please contact us at support@guitarking.com. We will process your request within a reasonable timeframe and provide you an email with a confirmation of the deletion. In order to prevent further storage of your information, you should refrain from contacting us again after receiving your confirmation of deletion. Failure to do so will result in us storing your information again, and you will need to request deletion again. Please be aware that deleting your information is a non-reversible action, and may interfere with any ongoing support requests you have with us. Please note, however, that we may need to retain certain information for record keeping purposes, to complete transactions or to comply with our legal obligations.
Request that we stop using your information: In some cases, you may ask us to stop accessing, storing, using and otherwise processing your information where you believe we don't have the appropriate rights to do so. For example, if you believe your personal information was given to us without your permission and where you gave us consent to use your information for a limited purpose, you can contact us to withdraw that consent, but this will not affect any processing that has already taken place at the time. You can also opt-out of our use of your information for marketing purposes by contacting us, as provided below. When you make such requests, we may need time to investigate and facilitate your request. If there is delay or dispute as to whether we have the right to continue using your information, we will restrict any further use of your information until the request is honoured or the dispute is resolved.
Opt out of communications: You may opt out of receiving communications from our support team by responding to any email you receive from us with a request to stop investigating your request or assisting you further.
Turn off Cookie Controls: Relevant browser-based cookie controls are described in our Cookies and Tracking Notice .
Send "Do Not Track" Signals: Some browsers have incorporated "Do Not Track" (DNT) features that can send a signal to the websites you visit indicating that you do not wish to be tracked. Because there is not yet a common understanding of how to interpret the DNT signal, our Services may not always respond to browser DNT signals. You can use the range of other tools we provide to control data collection and use, including the ability to opt out of receiving marketing from us as described above.
If you are located in the EEA, you also have the right to lodge a complaint with your local Data Protection Authority.
How we transfer collected information internationally?
International transfers of information we collect
Whenever data is transferred outside the EEA or the UK, we rely on Standard Contractual Clauses or other lawful transfer mechanisms to protect your information.
What is our policy towards children?
The Services can be used by users of all ages. We do not knowingly collect personal information from children. If a child or parent contacts us by email, we will use that information only to respond and then delete it. In the EEA, users must meet the minimum age required by law in their country (typically 13-16) to independently provide personal data such as contact information. If you are under this Age Limit, do not provide any personal information to us. If you are a parent of a child under the Age Limit and become aware that your child has provided personal information to us, please contact us at support@guitarking.com and you may request exercise of your applicable access, rectification, cancellation, and/or objection rights. If you are a California resident under the age of 18 and you wish to remove publicly available content, please contact us at support@guitarking.com.
If we learn that we have collected the personal data of a child under the age of 13 years, we will take reasonable steps to delete the personal data. This may require us to delete any ongoing support requests related to that child.
How will we notify you of changes to our Privacy Policy?
We may change this privacy policy from time to time. We will post any privacy policy changes on this page and, if the changes are significant, we will provide a more prominent notice by adding a notice on the Service homepage(s). We will also keep prior versions of this Privacy Policy in an archive for your review. We encourage you to review our privacy policy whenever you use the Services to stay informed about our information practices and the ways you can help protect your privacy.
If you disagree with any changes to this privacy policy, you will need to stop using the Services and request deletion of your personal information as outlined above.
